Welcome to Optimus Odd. These Terms of Service (“Terms”) are a binding agreement between you and Optimus Odd, Inc. (“Optimus Odd,” “we,” “us”) governing your use of our mobile applications, games, and website (collectively, the “Services”). Please read them carefully. By downloading, installing, or using any of our Services you agree to these Terms.
01 Eligibility & your account
You must be at least 13 years old (or the minimum age of digital consent in your region) to use the Services. If you are under the age of majority, you may only use the Services with the involvement of a parent or guardian. You are responsible for keeping your account credentials secure and for all activity under your account.
02 License to use the Apps
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the Apps on devices you own or control, for your personal, non-commercial use. This license is also subject to the applicable app store's terms (Apple's Licensed Application End User License Agreement or Google Play's Terms of Service).
03 Acceptable use
You agree not to: reverse engineer, decompile, or attempt to extract source code from the Apps except where permitted by law; use the Services to break any law or infringe anyone's rights; cheat, exploit, or manipulate game mechanics or leaderboards; upload malware or interfere with the Services; or resell, sublicense, or commercially exploit the Services without our written permission.
04 Purchases & subscriptions
Some Services offer in-app purchases and auto-renewing subscriptions. All purchases are processed by the app store you downloaded from, and are charged to your app-store account. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period; manage or cancel them in your app-store account settings.
Except where required by law or the app store's policies, purchases are non-refundable. Refund requests are handled by Apple or Google according to their policies.
05 Virtual items
Games may include virtual currency or items that have no monetary value, cannot be exchanged for cash, and are licensed — not sold — to you. We may manage, regulate, modify, or remove virtual items at any time, and they may be forfeited if your account is terminated.
06 Intellectual property
The Services, including all software, artwork, characters (yes, including the robot), text, and trademarks, are owned by Optimus Odd or our licensors and are protected by intellectual-property laws. Except for the license granted above, we reserve all rights. You may not use our name, logos, or branding without our prior written consent.
07 User content
If a Service lets you submit content (such as usernames, messages, or creations), you retain ownership but grant us a worldwide, royalty-free license to host, display, and use that content to operate and promote the Services. You are responsible for your content and represent that you have the rights to share it. We may remove content that violates these Terms.
08 Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure. Our commander robot's launch-date predictions are provided for entertainment only.
09 Limitation of liability
To the maximum extent permitted by law, Optimus Odd will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill arising from your use of the Services. Our total liability for any claim relating to the Services will not exceed the greater of the amount you paid us in the 12 months before the claim or USD $100.
10 Termination
You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue a Service. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and dispute resolution — will survive.
11 Governing law & disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Delaware, unless applicable local law grants you the right to bring a claim elsewhere. Nothing in these Terms limits any consumer rights that cannot be waived by law.
12 Changes to these Terms
We may update these Terms from time to time. If we make material changes we will provide reasonable notice within the Services or by other means and update the “Last updated” date above. Your continued use of the Services after the changes take effect means you accept the revised Terms.
